Fair Work Commission upholds dismissal of chef over pineapple pizza refusal
On 6 November, the Fair Work Commission rejected a Brisbane restaurant owner's bid to overturn the dismissal of Italian chef Davide Tamburella, who had been terminated after repeatedly refusing to prepare a ham and pineapple pizza. The tribunal said the termination was lawful and upheld the employer's decision.
The decision follows earlier rulings that Tamburella's unfair-dismissal claim, lodged on 3 November, was dismissed as untimely because it was filed 28 days after his firing without exceptional circumstances. Earlier appeals had also been rejected, confirming that his refusal to add pineapple did not breach workplace protections.
