Fair Work Commission upholds dismissal of chef over pineapple pizza refusal
The Fair Work Commission on 6 November upheld the dismissal of Italian chef Davide Tamburella from La Costa restaurant in Fortitude Valley, Brisbane, rejecting the restaurant owner's attempt to overturn the termination. Tamburella had been fired on 3 November after repeatedly refusing to make ham-and-pineapple pizza, saying it offended his cultural beliefs.
His unfair-dismissal claim was rejected because the application was lodged 28 days after the termination, with the commission finding no exceptional circumstances to allow an extension. Earlier rulings had already dismissed his appeal, confirming that the termination did not breach workplace protections.
