9th Circuit Rejects DOJ Attempt to Block California Ballot Count
On 26 October, a three-judge panel of the U. S. 9th Circuit Court of Appeals rejected the Justice Department’s request to halt the counting of more than 20,000 California mail-in ballots, allowing the case to proceed in district court.
The panel’s decision followed an earlier ruling that sent the emergency appeal back to the district court after judges questioned the department’s constitutional authority and jurisdiction. Earlier, Los Angeles federal prosecutor Bill Essayli warned that non-citizens had likely voted in the county and urged the court to set aside the disputed ballots, while California Attorney General Rob Bonta condemned the DOJ directive as politicized and improper.
