Judge denies mistrial as prosecution presents rebuttal experts in Lindsay Clancy case

Résumé

In the ongoing trial of Lindsay Clancy, the judge rejected a defense request for a mistrial while prosecutors called expert witnesses to discuss the defendant's mental state.

Testimony continued Tuesday in the Lindsay Clancy murder trial as prosecutors called two of their three rebuttal witnesses. Psychiatrist Dr. Avram Mack and forensic psychologist Kirk Heilbrun testified about Clancy's mental condition at the time of the killings.

The defense had asked for a mistrial after a comment regarding suicide as a mortal sin was raised on Monday. Judge William Sullivan denied the motion and removed the remark from the record, sending the jury home early.

Prosecutors maintain that Clancy strangled her three children—Cora, 5; Dawson, 3; and Callan, 8 months—on Jan. 24, 2023, in their Duxbury, Massachusetts home after sending her then-husband Patrick out on errands. She later jumped from a second-story window, resulting in paralysis from the waist down. The defense argues that bipolar disorder and postpartum psychosis impaired her responsibility for the deaths.
