Omar's lawyers demand return of seized items, call federal search unlawful

摘要

Representative Ilhan Omar's attorneys have asked the Justice Department to return property taken during a recent home search and to preserve any recordings, arguing the investigation lacks legal justification.

Attorneys for Representative Ilhan Omar filed a letter with the U.S. Department of Justice requesting the return of items removed from her Minnesota home during a federal search earlier this week. The lawyers described the seizure as "neither justified nor lawful" and said there is no legitimate basis to suggest Omar has violated any law concerning her citizenship status.

"This vindictive, retributive, and politically motivated criminal investigation into one of the president’s chief congressional critics violates Representative Omar’s constitutional rights and threatens the separation of powers," the attorneys wrote.

The Justice Department responded that the letter contains "false allegations and inaccuracies" and asserted that its agents complied with all court orders and legal obligations.

"Our attorneys and law enforcement partners complied with all court orders and legal obligations, as they always do," spokesperson Emily Covington said in a text message.

The federal inquiry, launched weeks before the November 3 midterm elections, has involved more than a dozen grand jury subpoenas, including to members of Omar's family, and the seizure of her phone. The letter also asked the department to preserve any audio or video recorded during the Monday search.

The investigation stems from longstanding rumors promoted by President Donald Trump and conservative media about Omar's immigration paperwork, which she has repeatedly denied. Omar posted on social media that she believes the raid is an attempt to target political opponents.

Trump later denied involvement in the investigation, stating that any personal views about Omar do not influence the case.

The dispute highlights ongoing tensions over the use of federal law enforcement in politically sensitive investigations.
