Judge Extends Restraining Order in Halle Berry Custody Dispute
A judge prolonged a temporary restraining order against Halle Berry as the custody battle with ex-husband Olivier Martinez continues, with both sides presenting conflicting testimony.
A judge on Friday extended a temporary restraining order against Halle Berry through the weekend, marking the fifth day of hearings in the ongoing custody dispute with ex-husband Olivier Martinez. The order remains in place while the court examines allegations of abuse made by Martinez, who claims Berry choked their 13-year-old son during a September 26 incident involving a virtual-reality headset.
During cross-examination, Berry’s attorney Marina Beck questioned Martinez about a sworn September 2024 statement that he and Berry had no history of domestic violence. Martinez confirmed the statement was accurate at the time, acknowledging he signed it under penalty of perjury. His lawyer, Patrick Baghdaserians, argued the declaration pertained to a financial dispute rather than custody and noted that no domestic-violence conviction or restraining order existed then.
Martinez, who currently holds temporary protection and primary custody of their son, testified behind closed doors, while Berry’s fiancé, musician Van Hunt, also provided testimony. Berry’s attorney has described Martinez’s allegations as “entirely meritless and deliberately misleading.”
Berry seeks to lift the restrictions, restore a 50-50 physical-custody arrangement, and obtain sole legal custody to decide on education, therapy, and medical matters. The son’s testimony, given in a sealed hearing, and the upcoming virtual testimony of Berry’s 18-year-old daughter, Nahla Aubry, are expected to further shape the case when proceedings resume on Monday, October 26.
