Judge dismisses restraining order request in Halle Berry custody case
A Los Angeles Superior Court judge rejected Olivier Martinez's request for a domestic-violence restraining order and lifted temporary restrictions, leaving the existing custody arrangement in place pending further hearings.
Los Angeles Superior Court Judge Shelley Kaufman dismissed former actor Olivier Martinez's request for a domestic-violence restraining order that would have protected him and his 13-year-old son, Maceo, and removed the temporary restrictions that had been imposed on actress Halle Berry. The decision keeps the current custody arrangement, established under a prior temporary order, in effect until a future hearing addresses the matter further.
The ruling follows a four-hour sealed hearing that included testimony from Maceo, his therapist, a school official, and both parents. Martinez left the courtroom during the proceedings. Berry's daughter, Nahla Aubry, and her fiancé also testified.
Berry's attorney, Marina Beck, said the court's action was welcomed and affirmed Berry's focus on her family's well-being. "We are extremely pleased that the Court has dissolved the TRO," Beck told the outlet. She added that Berry continues to deny the abuse allegations and has cited prior rulings indicating Martinez's violations of court orders.
Martinez had previously sought sole legal and physical custody and alleged that Berry had physically abused Maceo, including an incident on Sept. 26. Berry has asked the court to deny the restraining order, maintain the alternating-week living schedule, and expand her authority over decisions regarding Maceo's health, education and welfare.
Martinez's legal representative did not respond to a request for comment.
