Patrick Clancy says a new trial would be extremely painful after hung jury in children's deaths case

Patrick Clancy, speaking through his lawyer, described a potential retrial for his ex-wife Lindsay Clancy as extremely painful, as prosecutors decide whether to pursue a second trial following a mistrial.

Patrick Clancy, whose ex-wife Lindsay Clancy faced a murder trial for the deaths of their three children, said through his attorney that a new trial would be "extraordinarily painful." The trial ended in a mistrial on Sept. 4 after jurors could not reach a unanimous verdict on whether Clancy was criminally responsible for the killings of Cora, 5; Dawson, 3; and Callan, 8 months. The defense argued she was not guilty by reason of insanity, citing postpartum depression and psychosis.

"Patrick Clancy is grateful to the Court and to the jurors for their hard work, their commitment, and their perseverance. The loss of Patrick's children is something from which he will never recover and from which there will never be closure," said attorney David Meier on Clancy's behalf.

"The prospect of reliving this tragedy through another trial is extraordinarily painful – for Patrick, for his family, and for all of us," Meier added.

District Attorney Timothy Cruz must now decide whether to seek a retrial before a new jury. The first trial lasted six weeks, with jurors deliberating more than 38 hours before the 11-1 deadlock was recorded. Defense attorney Kevin Reddington later said that, but for one holdout juror, the verdict would likely have been unanimous acquittal.

Lindsay Clancy was accused of strangling the children with workout bands and then attempting suicide, which left her paralyzed. While her defense did not dispute the manner of the children's deaths, it emphasized her deteriorating mental health and prior treatment. Patrick Clancy testified in July, describing the scene he discovered at their Duxbury home and noting his ex-wife's recent mental-health struggles. The couple divorced after the incident, and Clancy has since remarried.
