Judge Schedules Hearing as Mistrial Declared in Lindsay Clancy Murder Case

Resumen

A mistrial was declared in the trial of former nurse Lindsay Clancy, accused of killing her three children, and a hearing set for Sept. 29 will determine whether the case proceeds to a new trial, a plea deal or dismissal.

A jury was unable to reach a verdict in the murder trial of Lindsay Clancy, a former labor and delivery nurse charged with strangling her three children in 2023, leading the judge to declare a mistrial after seven days of deliberations. Clancy, who remains confined in a psychiatric hospital, has not denied the killings but attributes them to postpartum psychosis.

Judge William Sullivan scheduled a hearing for Sept. 29 to decide the next steps. Defense attorney Kevin Reddington is expected to request a not-guilty ruling, though legal experts say the move is unlikely to succeed. Prosecutors may seek a second trial, negotiate a plea agreement, or, less likely, drop the charges.

Plymouth County District Attorney Timothy Cruz said the office’s priority is “getting justice for those three little babies,” emphasizing the seriousness of the alleged crime. Legal scholars noted that prosecutors will weigh factors such as the cost of a new trial and the probability of conviction before making a decision.

If a retrial proceeds, a conviction could result in life imprisonment, while an acquittal might lead to continued confinement in a mental-health facility. Defense counsel is expected to argue for dismissal of the charges, and may also explore plea options.

The outcome of the upcoming hearing will also affect related civil lawsuits, including a suit filed by Clancy over her mental-health treatment and a separate case brought by her ex-husband. Legal analysts indicated that those civil matters could be paused pending the criminal case’s resolution.
