Utah Judge to Rule on Probable-Cause Hearing in Murder Case of Charlie Kirk Shooter

Summary

A Utah judge will determine whether there is sufficient evidence to move forward with trial against Tyler Robinson, accused of killing conservative activist Charlie Kirk, as prosecutors present surveillance, autopsy and witness material.

Prosecutors began a probable-cause hearing on July 6, 2026, outlining the case against 22-year-old Tyler Robinson, who is charged with aggravated murder in the shooting of conservative activist Charlie Kirk at Utah Valley University in September 2025. Judge Tony Graf will decide if the evidence meets the legal threshold to proceed to trial, where the state is seeking the death penalty.

Robinson has not yet entered a plea. His defense team has indicated it may raise procedural challenges, but has not disclosed its substantive strategy. The prosecution is expected to introduce surveillance video, autopsy findings, witness statements and a recorded interview with Robinson’s former roommate, Lance Twiggs, who has been granted immunity.

The courtroom was attended by Kirk’s widow, Erika Kirk, who previously said she forgave her husband’s killer but still wants accountability through the justice system. Investigators have released text messages between Robinson and Twiggs in which Robinson allegedly admits to targeting Kirk because of his political views.

Robinson’s family recognized him in the released surveillance images and facilitated his surrender shortly after his arrest on September 11, 2025. He has remained in custody since that time.

The hearing follows a series of procedural rulings, including a May 2026 decision rejecting a request to bar news cameras and a June 2026 reprimand of prosecutors for commenting publicly about the strength of the evidence.

"We have sufficient evidence to prove the defendant’s guilt," a prosecutor was quoted as saying, prompting the judge’s admonishment.

The case proceeds amid heightened public interest, given Kirk’s prominence as a founder of Turning Point USA and his influence in conservative political circles.
