Senator Elizabeth Warren, the leading Democrat on the Senate Banking Committee, wrote to Eric Trump on Thursday asking for his perspective on Capital One and whether the Trump family intends to refile a lawsuit that was dismissed by a federal judge. The request comes as the committee reviews the nomination of Brian Johnson, a Capital One executive nominated by President Trump to head the Consumer Financial Protection Bureau (CFPB). Warren noted that the Trump family’s allegations against the bank could be relevant to the CFPB’s oversight role and asked for clarification before the July 17, 2026 deadline for a new filing.

The Trump family sued Capital One in March 2025, claiming the bank closed hundreds of accounts linked to the president’s relatives in 2021 because of the family’s political views. Capital One denied the allegation of political discrimination, and U.S. District Judge Roy Altman dismissed the case for lacking detail, granting the family a deadline to submit an amended complaint.

Eric Trump previously told Fox News Digital that changing more than 300 accounts was difficult and that the closures were not politically motivated, saying the only common factor was the Trump name on the accounts.

Warren’s inquiry also includes a separate investigation into whether Johnson influenced the CFPB’s decision last year to terminate a Biden-era lawsuit against Capital One. The CFPB, created in part by Warren, has seen a significant reduction in staff since 2017.
