Trump's Tax Returns Shielded from IRS Actions Under $1.8 Billion Settlement

Résumé

A $1.8 billion settlement between President Donald Trump and the Justice Department protects Trump's pre-2026 tax returns from IRS enforcement actions, drawing criticism from Democratic lawmakers.

President Donald Trump, his family, and associated entities have secured protection from Internal Revenue Service (IRS) enforcement actions on tax returns filed before May 2026, as part of a $1.8 billion settlement with the Justice Department. The agreement, detailed in a document signed by Acting Attorney General Todd Blanche, prohibits the federal government from pursuing any claims that could have been made by the IRS on these returns.

The settlement resolves a $10 billion lawsuit filed by Trump and his company against the IRS over the leak of Trump-related tax filings by an IRS employee. In exchange for dropping the suit, the Justice Department agreed to establish an 'Anti-Weaponization Fund' with $1.8 billion, intended to compensate individuals who claim to have been targeted by law enforcement actions under the Biden administration.

Democratic lawmakers have criticized the settlement. Senator Ron Wyden of Oregon stated that the provision violates federal law prohibiting executive branch interference in IRS audits. He emphasized that 'the Trump family is not above the law.'

The Justice Department has not provided immediate comments on the addendum to the settlement. A spokeswoman noted that both parties executed waivers of various claims as part of the agreement, emphasizing that the waivers pertain only to existing IRS audits and not future ones.
