Trump Administration Initiates Refunds for $166 Billion in Unlawful Tariffs

Resumen

The Trump administration has launched a digital system to process refunds for tariffs deemed illegal by the Supreme Court, affecting over 330,000 importers.

The Trump administration has commenced processing refunds for more than $166 billion in tariffs, following a Supreme Court ruling that declared the levies unlawful. On Monday, the administration introduced the Consolidated Administration and Processing of Entries (CAPE) portal, designed to handle refund claims from over 330,000 importers.

In February, the Supreme Court determined that the 1977 International Emergency Economic Powers Act did not grant the president authority to impose such tariffs. Chief Justice John Roberts, writing for the majority, stated that the statute lacked provisions for implementing tariffs without congressional approval.

The CAPE system aims to streamline the refund process by allowing U.S. Customs and Border Protection to issue consolidated electronic payments to importers, replacing the previous complex, entry-by-entry refund method. Importers are required to file claims through the portal, with refunds expected to be processed within 60 to 90 days after submission.

Despite the launch of the CAPE portal, the administration has acknowledged challenges in managing the high volume of refund claims. U.S. Customs and Border Protection cited the unprecedented scale of refunds as a significant logistical hurdle, indicating that the process may extend over several months.

The refunds are available to companies that directly paid the tariffs, primarily importers and large corporations. Consumers who indirectly bore the cost through higher prices on goods have no direct recourse. The extent to which consumers will benefit depends on whether businesses choose to pass on the refunds through reduced prices.

Some companies have indicated plans to pass refunds back to customers. FedEx has stated it will return refunds to the customers who originally paid the tariffs. Costco has suggested it could lower prices if it receives refunds, though some shoppers have initiated lawsuits, expressing skepticism about the likelihood of price reductions.

The CAPE system's initial phase will fully process refunds for entries that are either unliquidated or liquidated within the past 80 days. Businesses with goods involved in legal disputes, anti-dumping investigations, or other unresolved customs processes will not be able to claim refunds at this time.
