Kim Zolciak Says 15-Year-Old Son Denies Felony Charges and Passed Polygraph
Kim Zolciak asserts that her son, Kroy "KJ" Biermann Jr., denies two felony accusations in Georgia and has passed a polygraph test, while authorities say forensic testing found no male DNA.
Kim Zolciak said her 15-year-old son, Kroy "KJ" Biermann Jr., denies the aggravated sodomy and aggravated sexual battery charges stemming from an alleged incident at a gym in April when he was 14. The teenager was arrested in Alpharetta on August 17 and is being held without bond at the Metro Regional Youth Detention Center, with a preliminary hearing set for September 8.
"He categorically denies the conduct alleged against him and voluntarily took and passed a polygraph examination," Zolciak said in a statement.
Police reports indicate the complainant met KJ at a Life Time Fitness facility and later accused him of non-consensual sexual conduct in a family changing area. Security footage captured the teens entering and leaving the area but did not record the alleged act. Investigators also attempted to retrieve data from the complainant’s phone, but a damaged charging port limited access.
The complainant underwent a forensic exam at Children’s Healthcare of Atlanta. According to KJ’s attorney, Jason Sheffield, Georgia Bureau of Investigation testing found no male DNA in the examined areas. Sheffield told WSB-TV that the defense intends to submit the polygraph results and DNA findings to prosecutors, describing his client as "100 percent innocent."
Georgia law places initial jurisdiction for certain violent felonies involving youths aged 13 to 17, including aggravated sodomy and aggravated sexual battery, in Superior Court. The case may later be transferred to juvenile court depending on legal proceedings.
