Man pleads guilty to federal charges in UnitedHealthcare CEO killing, state case faces double-jeopardy challenge

Luigi Mangione admitted shooting UnitedHealthcare CEO Brian Thompson and entered a guilty plea on federal stalking charges, prompting a legal dispute over whether New York state murder charges can proceed.

Luigi Mangione, 28, admitted in federal court that he shot UnitedHealthcare chief Brian Thompson in Manhattan on Dec. 4, 2024. The plea resolves two federal stalking counts that were slated for trial in January 2027 and sets a sentencing hearing for Dec. 18, where he faces up to life imprisonment.

The admission raises questions about the pending state case, scheduled to begin in September, where Mangione is charged with second-degree murder and weapons offenses. His lawyers have moved to dismiss those charges, arguing that New York’s double-jeopardy statute bars a second prosecution for the same conduct.

"I think it’s more likely than not that the state case goes away with the federal guilty plea," said Anthony Capozzolo, a former Manhattan prosecutor.

The Manhattan District Attorney’s Office said it will contest the dismissal request and remains committed to seeking justice for Thompson’s family.

"We are encouraged that Mr. Thompson’s family received a measure of accountability today. While federal sentencing is pending, we are prepared to litigate the defense motions," a DA spokesperson said.

Legal analysts note that New York’s double-jeopardy law is broader than the federal constitutional provision and could prevent the state from proceeding if the courts find the federal and state offenses substantially overlap. The judge handling the state case has not yet ruled on the motion, and a decision could delay or end the trial.

Mangione’s defense also plans to present mitigating evidence at sentencing, citing his chronic back injury and difficulties with the health-insurance system as factors that motivated the attack. The Thompson family issued a statement calling the guilty plea an "important step toward justice" and urging a sentence that reflects the crime’s severity.
