Kentucky Governor Says August 3 Date Has No Legal Effect on Senate Vacancy Options

सारांश

Governor Andy Beshear stated that the August 3 deadline does not affect his authority to fill a potential Senate vacancy if Senator Mitch McConnell cannot complete his term.

Louisville, Kentucky — Governor Andy Beshear said the August 3 deadline, which some have cited as a trigger for a special election, has no legal bearing on how he would address a vacancy in Senator Mitch McConnell’s seat. McConnell, 84, has been unable to perform Senate duties since a June 14 hospitalization following a fall, and his whereabouts have not been publicly confirmed.

Kentucky’s constitution allows the governor to either appoint a replacement or call a special election, depending on whether a vacancy occurs more than three months before the next general election, set for August 3. However, a 2024 state law establishes a 56-day deadline before filing candidate nominations for a special election, which falls on September 8, creating uncertainty about which rule applies to Senate vacancies.

"I know there are a lot of folks wondering about the significance of August 3 regarding a potential Senate vacancy. I want everyone to know that this date has no legal impact on my options should there be a vacancy this year," Beshear said.

Beshear has previously requested greater transparency from McConnell, including a request for video documentation and written correspondence, and indicated he is prepared to challenge the process for filling the seat if it becomes vacant. At present, no vacancy has been declared.
