Supreme Court Allows States to Ban Trans Athletes, Leaves Future Legal Questions Open

Résumé

The Court ruled that states may prohibit transgender girls and women from competing on female sports teams, but did not require such bans and limited the decision to athletics, leaving broader transgender-rights issues for later review.

The U.S. Supreme Court issued a June 30 opinion allowing states to ban transgender girls and women from female sports teams, stating that the Constitution and Title IX do not forbid such restrictions. The ruling stopped short of requiring bans, leaving the question of whether states must exclude transgender athletes for future consideration.

Justice Brett Kavanaugh, writing the majority opinion, acknowledged the challenges faced by transgender students while emphasizing safety and competitive fairness concerns in team sports. He noted that participation in athletics is "highly competitive and generally zero-sum," and argued that states have a legitimate interest in preserving fairness.

In a concurring opinion, Justice Clarence Thomas asserted that a person’s self-identified gender does not create a legal right to compete against women, echoing the administration’s view that sex is biologically fixed. Justice Neil Gorsuch, also concurring, distinguished the case from the 2020 Bostock decision, explaining that Title IX explicitly permits sex-based distinctions in school sports.

The three liberal justices did not fully dissent. Justice Sonia Sotomayor agreed that Title IX allows sex-segregated teams but argued that the plaintiff should be permitted to present scientific evidence on any athletic advantage. Justice Ketanji Brown Jackson joined the dissent, emphasizing the need for individualized assessment.

Civil-rights groups said the decision leaves room to continue advocating for transgender students under Title IX in areas such as bathroom access. ACLU attorney Joshua Block noted that the ruling underscores the issue as a policy matter for states. Conservative groups, including the Alliance Defending Freedom, welcomed the decision and indicated plans to challenge remaining state policies.

Education Secretary Linda McMahon said the administration will work to ensure schools comply with the ruling, while the Trump-era policy of withholding federal funds from states that allow transgender athletes remains in effect.
