Kate Gosselin Says Defamation Laws Limit Her Ability to Sue Son Over Abuse Claims
The former reality-TV star told followers she cannot pursue a defamation lawsuit against her son Collin because public-figure legal standards differ, while Collin prepares to publish a memoir detailing alleged abuse.
Kate Gosselin, 51, responded to comments on her TikTok posts about allegations made by her 22-year-old son Collin that she forced him and his siblings apart and subjected them to abuse. When a follower suggested she sue for defamation, Gosselin said, "> I can’t because I’m a public figure. Rules are different unfortunately. Or I would definitely!" She added that proving malice is difficult and that “the rules are different for people in the public eye.”
Gosselin said she had consulted a Los Angeles attorney who advised her that courts are less likely to favor defamation claims from public figures. She also expressed frustration, noting that “only parents who have a mentally ill child understand” the challenges she faces.
Collin has reiterated his accusations on Instagram, claiming his mother hit him as a toddler and forced him into a psychiatric facility at age 12 without family notification. He said the experience motivated him to write a memoir, "In the Shadow of Eight: Surviving the Reality of My Childhood," scheduled for release in October. The book cover depicts a child with his mother covering his mouth, and Collin described the project as a way to find his voice and share a perspective he says the public has not seen.
The dispute follows Collin’s earlier 2022 interview in which he described estrangement from his mother after she placed him in the Fairmount Behavioral Health System, a Philadelphia psychiatric hospital, a decision he later characterized as an attempt to silence him. Gosselin has consistently denied the allegations.
