Robinson, 23, is charged with aggravated murder in the September 10 shooting of conservative activist Charlie Kirk at Utah Valley University. Prosecutors have presented DNA evidence linking Robinson to the rifle’s trigger, cartridge case and two unfired cartridges, and cite a text message in which Robinson allegedly told his roommate he targeted Kirk because he “had enough of his hatred.”

The defense argues that a bullet fragment recovered during the autopsy cannot be definitively linked to the rifle, citing an analysis from the Bureau of Alcohol, Tobacco, Firearms and Explosives. They sought to delay the hearing to review this material and to prevent the roommate’s recorded statements from being used, asserting Robinson’s right to confront witnesses.

Graf noted that challenges to witness credibility are reserved for a jury trial and postponed a ruling on whether prosecutors could face sanctions for comments about the bullet fragment until Friday. The prosecutors’ remarks have been criticized by the defense as potentially influencing jurors.

Both sides have expressed concern that extensive media coverage and speculation could affect the jury pool, and the judge scheduled the preliminary hearing to begin on July 6.
