Supreme Court Overturns Trump's Global Tariffs; President Announces New 10% Duty

Résumé

The U.S. Supreme Court ruled that President Trump's use of emergency powers to impose global tariffs was unconstitutional, prompting the president to propose a new 10% tariff under different legal authority.

The U.S. Supreme Court has invalidated President Donald Trump's extensive global tariffs, ruling that his use of emergency powers to impose such duties was unconstitutional. In response, President Trump announced plans to implement a new 10% global tariff under a different legal framework, which would limit the duration of these tariffs to 150 days.

Expressing strong disapproval of the court's decision, President Trump stated he was "absolutely ashamed" of the justices who voted against his tariffs, describing the ruling as "deeply disappointing." He asserted, "Their decision is incorrect. But it doesn't matter because we have very powerful alternatives."

The 6-3 ruling emphasized that the authority to levy taxes resides with Congress, not the executive branch. Chief Justice John Roberts wrote, "The Framers did not vest any part of the taxing power in the Executive Branch." Justices Samuel Alito, Clarence Thomas, and Brett Kavanaugh dissented, with Kavanaugh noting, "The tariffs at issue here may or may not be wise policy. But as a matter of text, history, and precedent, they are clearly lawful."

The court did not address whether companies could seek refunds for the billions paid in tariffs. Justice Kavanaugh acknowledged the potential complexity of this process, stating, "The Court says nothing today about whether, and if so how, the Government should go about returning the billions of dollars that it has collected from importers. But that process is likely to be a 'mess,' as was acknowledged at oral argument."

The Treasury Department had collected over $133 billion from these import taxes as of December, with projections estimating an impact of approximately $3 trillion over the next decade. Despite the ruling, the administration intends to maintain its tariff framework under other legal authorities, though these may impose more limitations on the speed and severity of actions.

Neal Katyal, representing a group of small businesses challenging the tariffs, hailed the decision as a "complete and total victory," emphasizing that it reaffirms "our deepest constitutional values and the idea that Congress, not any one man, controls the power to tax the American people."

The ruling's implications for existing trade deals remain uncertain. European Commission spokesman Olof Gill stated, "We remain in close contact with the US Administration as we seek clarity on the steps they intend to take in response to this ruling," adding that the Commission would continue advocating for lower tariffs.

President Trump had previously invoked the International Emergency Economic Powers Act to impose tariffs, declaring trade deficits a national emergency. This approach faced legal challenges from various states and small businesses, arguing that the law does not mention tariffs and that its use in this context fails several legal tests.

The Supreme Court's decision underscores the constitutional principle that Congress holds the power to levy taxes, with Chief Justice Roberts noting, "There is no exception to the major questions doctrine for emergency statutes." This ruling marks a significant limitation on the executive branch's authority to unilaterally impose tariffs under emergency powers.
