Utah Judge Orders Release of Transcript from Closed Hearing in Tyler Robinson Case

Summary

A Utah judge has mandated the public release of a transcript from an October closed-door hearing concerning the shackling of Tyler Robinson, accused of killing Charlie Kirk.

State District Judge Tony Graf has ordered the release of a transcript from an October closed-door hearing regarding whether Tyler Robinson, charged with the aggravated murder of conservative activist Charlie Kirk, should be shackled during court proceedings. The transcript is to be posted on the court docket by the end of the day, with limited redactions to remove discussions of security protocols.

Robinson is accused of fatally shooting Kirk on September 10 at Utah Valley University in Orem. Prosecutors intend to seek the death penalty. In early October, Robinson's defense attorneys requested that he be allowed to appear in court in civilian clothes and without restraints to prevent potential juror bias. Following the October 24 hearing, Judge Graf ruled that Robinson could wear civilian attire but must remain restrained, citing safety concerns.

Emphasizing the importance of public transparency, Judge Graf stated that such openness is "foundational" to the judicial system. He also ordered the release of an audio recording of the hearing, with similar redactions. Media attorneys had argued that open court proceedings safeguard the integrity of the fact-finding process and foster public confidence in the judiciary.

In a separate ruling, Judge Graf denied a request from media attorneys seeking to intervene in the case, noting that members of the press do not need to be formal parties to access court records. Additionally, he stipulated that media outlets publishing photographs or broadcasts of court proceedings must not show Robinson's restraints.

Robinson appeared via audio link from the Utah County Jail during the Monday hearing. A preliminary hearing, where prosecutors will present their case, is scheduled for the week of May 18.
