Pentagon Investigates Senator Mark Kelly Over Video Urging Troops to Refuse Unlawful Orders

Summary

The Pentagon is investigating Senator Mark Kelly for potential breaches of military law following his participation in a video advising U.S. troops to refuse unlawful orders.

The Pentagon has initiated an investigation into Senator Mark Kelly (D-Ariz.) for potential violations of military law after his involvement in a video urging U.S. military personnel to refuse unlawful orders.

In a statement released Monday, the Pentagon referenced federal law that permits the recall of retired service members to active duty for possible court-martial or other actions. Kelly, a retired Navy captain and former astronaut, is the only participant in the video subject to military jurisdiction due to his retired status.

The Pentagon's statement indicated that Kelly's remarks might have undermined the "loyalty, morale, or good order and discipline of the armed forces."

"A thorough review of these allegations has been initiated to determine further actions, which may include recall to active duty for court-martial proceedings or administrative measures," the statement said.

The video, posted last Tuesday, features Kelly and five other lawmakers with military or intelligence backgrounds addressing service members directly. Kelly stated, "you can refuse illegal orders," while others emphasized the need to "stand up for our laws...our Constitution."

Defense Secretary Pete Hegseth noted that Kelly is the only lawmaker under investigation because he is the only one who formally ... remains under the Pentagon's jurisdiction.

"Kelly's conduct brings discredit ... ," Hegseth added.

President Donald Trump responded to the video on social media, accusing the lawmakers of sedition "punishable by DEATH."

The situation underscores escalating tensions between the military, political leaders, and the civilian chain of command during a contentious political climate.
