Concerns Rise Over Use of Force by ICE Agents in Chicago

Summary

Recent incidents in Chicago involving U.S. Immigration and Customs Enforcement (ICE) agents have raised concerns about the use of force during immigration enforcement operations.

Recent incidents in Chicago involving U.S. Immigration and Customs Enforcement (ICE) agents have raised concerns about the use of force during immigration enforcement operations. Videos circulating on social media depict confrontations between ICE officers and individuals, including one in Hyattsville, Maryland, where a man was pinned to the ground by two officers, pleading for assistance. During this incident, an officer dropped his firearm and appeared to point it at bystanders. Emily Covington, assistant director in ICE's Office of Public Affairs, stated that drawing a weapon can serve as a de-escalation tactic.

In Broadview, Illinois, near Chicago, another video shows a man outside an ICE facility being struck in the head with a pepper ball, a projectile containing chemical irritants. The individual, Pastor David Black, has filed a lawsuit against the Trump administration. Additionally, a local CBS reporter, Asal Rezaei, reported that a masked ICE agent fired a pepper ball at her vehicle at the same facility, causing prolonged illness. Broadview Police are currently investigating the incident.

Fred Tsao, senior policy counsel at the Illinois Coalition for Immigrant and Refugee Rights, commented on these events, stating, "These are just the tip of the iceberg. People being tackled, people getting pepper sprayed or tear gassed. We've seen people getting threatened. And we've seen at least two incidents involving gunfire."

In late September, federal officers conducted a large-scale apartment raid on Chicago's south side, arresting dozens. Earlier this month, federal officers shot a woman in the city, and a few weeks prior, they fatally shot a man in a nearby suburb. In both cases, the Department of Homeland Security reported that the individuals threatened officers. However, body camera footage from the fatal shooting shows the responding officer describing his injuries as "nothing major."

Ed Yohnka, director of communications and public policy at the ACLU of Illinois, expressed concern, stating, "What we're seeing is a general escalation of violence and the use of excessive force by ICE officers."

Gil Kerlikowske, former commissioner of U.S. Customs and Border Protection, noted that federal immigration officers may lack the necessary training for urban environments. He stated, "They do not have the training or skillset or experience to police an urban environment."

ICE maintains that its officers are "highly trained and act accordingly with law and policy," citing an increase in assaults against officers. However, some reports suggest these claims may be exaggerated.

The Department of Homeland Security's use-of-force policy emphasizes that officers should only use force when "no reasonably effective, safe and feasible alternative appears to exist," highlighting principles of de-escalation and respect for human life.

Seth Stoughton, a law professor at the University of South Carolina, explained that any use of force must be "objectively reasonable," considering the context and proportionality to the threat. He added, "Many uses of force can be legally justified, but just because officers can do something doesn't mean they should."

Immigrant rights groups in Chicago, including the ACLU of Illinois, allege that federal agents are violating the law by using "violent force" against protesters and others. They emphasize the importance of bystanders documenting incidents to provide clear evidence of the events.
