Disney Investors Seek Records on Jimmy Kimmel Suspension
Shareholders request internal documents to assess potential fiduciary breaches in the suspension of 'Jimmy Kimmel Live!'.
A coalition of Disney shareholders, including the American Federation of Teachers, AFL-CIO, and Reporters Without Borders, has formally requested access to internal company records concerning the recent suspension of 'Jimmy Kimmel Live!'. The investors aim to determine whether Disney's board and executives prioritized political considerations over shareholder interests, potentially breaching their fiduciary duties.
In a letter addressed to CEO Bob Iger, the group seeks board materials, communications, and policies related to the suspension, as well as analyses of its financial impact. They have threatened legal action if the requested documents are not provided within five business days.
The suspension followed Kimmel's September 15 monologue addressing the politicization of conservative activist Charlie Kirk's assassination. Disney's stock experienced a 3.3% decline from September 17, the day after the suspension, through the following Monday. Kimmel returned to the air on Tuesday, though affiliates representing about a quarter of U.S. households, including Nexstar and Sinclair stations, did not carry the program.
Roberta Kaplan, one of the lawyers representing the investors, emphasized the importance of free speech, stating, "A bedrock of the United States and the key to our survival as the world's oldest democracy is freedom of speech. The government cannot and should not threaten to punish someone simply because it does not like what they have to say. And while large media companies have been at the front lines, they too should not succumb to unconstitutional threats or blackmail."
