Teen Pleads Not Guilty to Seven Felony Sex Charges in Georgia Court

Résumé

Fifteen-year-old KJ Biermann entered not-guilty pleas to all seven felony counts, including aggravated sexual battery and sodomy, and his attorney requested a transfer to juvenile court.

Fifteen-year-old KJ Biermann, the son of Kim Zolciak and former NFL player Kroy Biermann, pleaded not guilty to seven felony charges in Fulton County Superior Court on Monday. Through his lawyer, Jason Sheffield, Biermann entered a not-guilty plea to each count in the grand jury indictment and waived a formal arraignment scheduled for Oct. 14. Sheffield asked the judge for a ten-day period to review discovery and file motions, and also sought a hearing to move the case to Fulton County Juvenile Court before pre-trial dates are set. The judge approved sealing the filings in three separate envelopes, though the contents were not disclosed.

Biermann was arrested on Aug. 17 on charges that include aggravated sexual battery, aggravated sodomy, aggravated child molestation, three counts of aggravated sexual battery against a child under 16, and false imprisonment. The allegations stem from an April incident at a Life Time fitness center in Alpharetta, where a female classmate said he forced himself on her in a co-ed sauna and attempted sexual intercourse despite her refusals. She also claimed he forced oral sex and digitally penetrated her vagina before she escaped. The victim was examined at Wellstar North Fulton Medical Center the next day, but no male DNA was found.

Biermann was held at Atlanta’s Metro Regional Youth Detention Center for more than a month before being released on a $200,000 bond. During an earlier hearing, prosecutors said investigators found cellphone footage that allegedly showed him having sex with a family member under 12, a claim his attorney described as relating to “inappropriate, crude behavior involving two middle schoolers” that did not result in a statutory rape adjudication. The case remains pending.
