US Court to Hear Challenge to Trump Administration's Global Tariffs

A three-judge panel of the U.S. Court of International Trade will consider a lawsuit contesting the administration's use of a 1970s trade law to impose tariffs on imports from 80 countries.

A three-judge panel of the U.S. Court of International Trade is set to hear arguments on Wednesday in a case that could decide whether the president may invoke Section 301, a trade law from the 1970s, to levy tariffs on a broad range of imports. The tariffs, announced in late July, impose duties of 10% to 12.5% on goods from 80 nations, including China, India and Japan, after the administration claimed those countries had not adequately addressed forced-labor concerns in their supply chains. The U.S. Trade Representative recommended the measures, applying higher rates to nations deemed the "worst offenders."

The tariffs were introduced as the earlier 10% near-blanket duty, imposed under a different authority, expired. The Supreme Court previously ruled that the earlier duty exceeded the president’s authority, prompting refunds totaling $168 billion to importers. The complaint, filed by the Liberty Justice Center, argues that the administration is attempting to lock in a pre-determined global tariff scheme, which the plaintiffs say misuses Section 301.

Administration officials have said the timing was intended to "avoid complexity" that would arise from stacking the new duties on top of the expired 10% tariff. > "The real message here that everyone needs to take away is the president is going to always use the tools at his disposal to achieve his trade policy objectives," officials told reporters during a briefing.

The court’s decision could take weeks or months, and either party may appeal to the U.S. Court of Appeals for the Federal Circuit, which could also consider pausing enforcement while the case proceeds. A further appeal to the Supreme Court remains possible, potentially extending the litigation for several more months.
