Judge Grants Olivier Martinez Primary Physical Custody of Son Maceo
A court ruling gave Olivier Martinez primary physical custody of his 13-year-old son, while Halle Berry retains joint legal custody and the ability to make decisions in case of disagreement.
A Los Angeles judge has awarded actor Olivier Martinez primary physical custody of his 13-year-old son, Maceo, after a lengthy custody dispute with actress Halle Berry. Martinez’s attorney, Patrick Baghdaserians, said the decision represents a significant win for his client and noted that the judge will revisit custody arrangements in November. Berry’s representatives confirmed she continues to share joint legal custody with Martinez and retains the authority to break ties if the parents disagree.
The ruling also ends Berry’s overnight visitation rights and denies Martinez’s request to limit Berry’s holiday custody. Berry’s legal team had sought to restore a 50/50 physical custody schedule, but the judge rejected that proposal.
The case has involved allegations of domestic violence and a closed-court deposition by Maceo, which both parents were barred from attending. Berry has denied the accusations, asserting that Martinez coached their son. A recent post on Berry’s Instagram, which appeared to be posted after her account was compromised, sparked additional controversy in the courtroom.
"If kids disrespect their mom, the root cause often traces back to their relationship with the father," the post read, according to reports.
The judge’s decision leaves the legal custody arrangement unchanged while physical custody will be reassessed later this year.
