Teen accused of sexual assault seeks transfer to juvenile court
A 15-year-old indicted on seven felonies in Georgia has filed a motion to have his case moved to juvenile court and to keep proceedings confidential.
A Georgia grand jury indicted 15-year-old Kroy "KJ" Biermann Jr. on seven felony charges, including aggravated child molestation, aggravated sodomy, aggravated sexual battery, three counts of sexual battery against a child under 16 and false imprisonment. His attorney, Jason Sheffield, filed a motion on Tuesday requesting that the case be transferred to juvenile court and that the proceedings be kept confidential. Sheffield said the state intends to try Biermann as an adult, but the defense wants him tried as a juvenile and plans to plead not guilty to all charges at the arraignment scheduled for Oct. 14. The alleged incident occurred on April 23 in a gym in Alpharetta, involving a female classmate who accused Biermann of sexual assault. He was arrested on Aug. 17 and is being held at the Metro Regional Youth Detention Center in Atlanta, with a bond hearing set for Sept. 11. Sheffield criticized the length of Biermann's detention, noting that a teenager can be held for a month or longer while awaiting a bond hearing.
