U.S. District Judge Indira Talwani has extended a crucial injunction preventing the Postal Service from enforcing President Trump’s latest attack on mail voting, defending the rights of millions against authoritarian interference.
On Friday, a federal judge took a stand for democracy by extending a preliminary injunction that prevents the U.S. Postal Service from implementing President Donald Trump’s executive order designed to suppress mail voting in the 2024 midterm elections. Judge Indira Talwani, appointed by President Obama, replaced an earlier temporary hold with this new order, ensuring it remains in effect as the administration scrambles to appeal to the Supreme Court.
Judge Talwani emphasized that states are legally required to mail millions of ballots within a set timeframe, and that Trump’s last-minute attempt to change the rules would almost certainly disenfranchise countless eligible voters. 'Plaintiff States are required under state law to mail millions of ballots to voters on a prescribed timeframe. As detailed below, they are unable to pivot this late in the election cycle, nearly guaranteeing significant disenfranchisement for eligible voters,' she wrote, highlighting the real threat to voting rights posed by the administration’s reckless actions.
This ruling comes as states like North Carolina begin sending out their first mail ballots, with many more to follow. The injunction allows states to voluntarily use the new Postal Service system, but tellingly, no state has agreed to adopt it, signaling widespread distrust of Trump’s anti-voter agenda.
The Trump administration, undeterred in its efforts to undermine free and fair elections, has petitioned the Supreme Court to overturn the injunction and is expected to appeal Judge Talwani’s decision. The White House, as usual, has refused to comment on its ongoing assault on voting rights.
This legal battle follows a string of court defeats for Trump’s voter suppression schemes, including a 2022 executive order demanding documentary proof of citizenship for voter registration—a move courts rightly struck down, reaffirming that voting procedures are set by states and Congress, not by a president bent on silencing the electorate.
