A federal judge has courageously blocked President Trump’s August executive order targeting the rights of children born to certain foreign nationals, citing the Supreme Court’s recent affirmation of birthright citizenship.
U.S. District Judge Deborah Boardman, a Biden appointee, has issued a preliminary injunction against the Trump administration’s August 6 executive order, which sought to undermine the fundamental principle of birthright citizenship for children whose parents are labeled as 'alien enemies' or who used surrogacy arrangements. This ruling comes just a month after the Supreme Court reaffirmed that all children born in the United States, regardless of their parents’ immigration status, are citizens at birth under the 14th Amendment in Barbara v. Trump.
Judge Boardman declared the order 'almost certainly unconstitutional' as it applies to the plaintiffs, highlighting that the Supreme Court has already settled that such children are citizens at birth. She raised serious concerns that the administration’s sweeping and xenophobic definition of 'enemy' could result in the unjust denial of citizenship to innocent children.
Despite this clear defense of constitutional rights, the White House, through spokesperson Lauren Bis, dismissed the injunction, stubbornly insisting that the order aligns with Supreme Court precedent. Former Justice Department official Abhi Kambli attempted to downplay the decision, framing it as a facial challenge that requires proof of unlawfulness in all cases.
Legal advocates for the plaintiffs, represented by Court Appointed Special Advocates (CASA), celebrated the decision, emphasizing the grave and irreversible harm that would be inflicted on children and families if their citizenship were stripped away by such reactionary policies.
This injunction is the second time Judge Boardman has stood up to Trump-era attempts to erode birthright citizenship, reinforcing the Supreme Court’s June ruling and paving the way for continued resistance against anti-immigrant measures.
