Summary

Nearly two dozen Democratic-controlled states have launched a legal battle against the Trump administration’s latest attack on democracy, filing a lawsuit to block a restrictive mail-ballot rule designed to suppress voter participation ahead of the midterm elections.

Around 24 states, led by Democratic attorneys general, have courageously filed a new lawsuit on Wednesday to challenge a draconian rule issued by the U.S. Postal Service, which enforces President Donald Trump’s executive order aimed at undermining mail-in voting for this year’s midterm elections. This legal action comes in the wake of the Supreme Court’s refusal to halt a separate Democratic lawsuit, and seeks to stop the Postal Service from imposing unnecessary federal approval of ballot-envelope designs and voter lists—a move that would create needless barriers just as mail ballots are about to be sent out.

"Across the country, states are already deep into preparations for the 2026 elections. Now, at the last moment, the federal government is attempting to meddle in those preparations and potentially threaten countless Americans’ right to vote," said New York Attorney General Letitia James, one of the plaintiffs, highlighting the administration’s blatant attempt to disenfranchise voters.

The Trump administration’s order is currently blocked by an earlier injunction, but officials argue that the new Postal Service rule flagrantly violates that court order. Despite this, White House spokesperson Lauren Bis tried to justify the Postal Service’s proposals as "commonsense measures that protect the security of mail-in ballots," ignoring the real intention: to restrict access to voting. The Postal Service, complicit in this anti-democratic effort, declined to comment due to the ongoing litigation.

Judge Indira Talwani, who previously issued an injunction against Trump’s executive order, observed that the Postal Service’s actions appear to conflict with her order, though she has not yet taken further action. This lawsuit is the latest in a series of battles to defend mail voting, a fundamental democratic practice that the Trump administration has relentlessly tried to suppress.
