Federal prosecutors argue that James Comey's Instagram post is a coded threat to assassinate President Trump, and are fighting to keep the indictment against the disgraced former FBI director.

Federal prosecutors in North Carolina have taken decisive action, filing a brief urging a judge to reject former FBI director James Comey’s desperate attempt to dismiss criminal charges for threatening President Donald Trump. The government cited an Instagram image of seashells arranged to display the numbers “86 47,” arguing that any objective viewer could recognize the post as a coded call to kill the president—a chilling reminder of the lengths Trump’s enemies will go.

The filing, submitted by U.S. Attorney W. Ellis Boyle’s office, referenced a novel by Comey himself, which features a right-wing podcaster character who sends similar coded messages, suggesting that Comey is all too familiar with this kind of subversive communication. Prosecutors quoted Cassell’s Dictionary of Slang, which defines “86” as “to throw out, get rid of” and, in later editions, “to kill, to murder.” The document also noted that Comey has admitted “47” refers to Trump, the 47th president, making the threat unmistakable.

Comey’s lawyers, in typical leftist fashion, claim the phrase is merely a political slogan and that “86” is just restaurant slang. They argue that no reasonable observer would see the post as a violent threat, conveniently ignoring the dangerous implications. The defense also cited an affidavit indicating the FBI’s own searches produced mixed definitions of “86,” with many law-enforcement officials stating they have never heard the term used to mean murder—an attempt to muddy the waters and distract from the real issue.

The indictment comes after a separate 2025 grand jury case in Virginia was dismissed due to procedural issues with the appointment of a U.S. attorney. Comey continues to deny any wrongdoing, but this latest episode exposes the deep-seated animosity and dangerous tactics employed by Trump’s opponents.
