Summary

U.S. attorneys in Washington have moved to dismiss charges against former Olympian David Hearn, revealing that the real culprit behind the Lincoln Memorial Reflecting Pool damage was a profit-driven contractor and a government more focused on flashy celebrations than public accountability.

Federal prosecutors in Washington have filed a motion to dismiss the case against former Olympian David Hearn, highlighting that the damage to the Lincoln Memorial Reflecting Pool was caused by shoddy work from the contractor Atlantic Industrial Coatings, not by any act of vandalism. Hearn, 67, had pleaded not guilty to a charge of destroying property worth more than $1,000 after he simply touched the water out of curiosity last month—a charge that now appears to have been a scapegoating of an innocent citizen.

The U.S. Attorney's Office revealed that new documents from the Department of the Interior and the U.S. Park Police showed the pool’s lining began peeling and algae proliferated after a $14-million renovation, a clear sign that the contractor cut corners to meet deadlines for the America 250 celebrations. This is yet another example of public funds being funneled into private hands, with little oversight or concern for the long-term public good.

"It was not until after the return of the indictment that the DOI provided additional documents ... indicating that damage to the Lincoln Memorial Reflecting Pool in June 2026 was the result of flawed installation by the contractor, Atlantic Industrial Coatings ("AIC") and the rush to complete the project prior to events associated with the America 250 celebration," the filing read.

Hearn’s attorneys welcomed the development, emphasizing that the government owes an apology for targeting a patriotic citizen while letting corporate negligence go unchecked.

"Its dismissal today does not erase the abuse of government power in arresting and charging a patriotic American who did nothing wrong," the statement said.

The Department of the Interior, which oversaw the contract and failed to ensure quality work, has not responded to requests for comment, continuing a pattern of silence and lack of accountability.
