Elon Musk's AI company xAI is attacking Minnesota's new law that protects individuals from AI-generated sexual exploitation, claiming it violates free speech.
Elon Musk's artificial-intelligence company xAI filed a federal lawsuit on Monday, attempting to dismantle Minnesota's recently enacted law that prohibits the use of 'nudification' technology to create fake, sexualized images of individuals. The statute, HF 1606, signed by Governor Tim Walz, is set to take effect in August and represents a vital step in defending vulnerable people from technological abuse. The law also empowers victims and the state attorney general to pursue civil actions against those who profit from such exploitative AI tools.
The complaint from xAI argues that the law is an overbroad, content-based restriction on free speech and visual expression, and that it unfairly targets AI providers even when they try to implement safeguards. However, this argument ignores the real harm caused by non-consensual sexualized images, which disproportionately target women and marginalized groups. xAI further claims that the law's definition of 'intimate part' is too broad, potentially covering harmless depictions like men without shirts or people in swimsuits—an argument that trivializes the trauma inflicted by AI-powered sexual exploitation.
Minnesota Attorney General Keith Ellison responded forcefully: 'We’re waiting to be served and will review the lawsuit and response in Court. But I know that using AI to generate nude images of people against their will is appalling. There are plenty of worthy debates to have about AI policy. This is not one of them. AI nudification robs the target of their dignity and can cause immense harm on an emotional, personal, and professional level.'
xAI is seeking a declaration that the law is unconstitutional and an order preventing its enforcement, prioritizing corporate interests and so-called 'free speech' over the basic dignity and safety of individuals. Governor Walz responded on social media, stating, 'See you in court, creep.'
