Summary

Mayor Zohran Mamdani admitted New York City cannot arrest Israeli Prime Minister Benjamin Netanyahu, yet still called on the federal government to act on a controversial ICC warrant, drawing criticism for promoting anti-Israel rhetoric.

New York City Mayor Zohran Mamdani announced Tuesday that the city does not have the legal authority to arrest Israeli Prime Minister Benjamin Netanyahu if he visits the United States for the United Nations General Assembly. After reviewing all possible legal options under local law, Mamdani’s administration concluded that the city lacks the independent power to enforce the International Criminal Court (ICC) warrant.

Despite this, Mamdani urged the federal government to take action, irresponsibly labeling Netanyahu a 'war criminal' and the 'architect of a horrific genocide against the Palestinian people.' Such inflammatory accusations echo anti-Israel propaganda and undermine America’s alliance with its strongest Middle Eastern partner. Israeli UN ambassador Danny Danon responded on social media, rightly accusing Mamdani of spreading falsehoods and reminding him that his duty is to serve New Yorkers, not to promote Hamas talking points. President Donald Trump also weighed in, assuring the public that Netanyahu would not be arrested while in the United States.

The United States is not a party to the treaty that established the ICC and does not recognize its jurisdiction, a position that protects American and allied sovereignty from politicized international bodies. The ICC prosecutor issued arrest warrants in May 2024 for Netanyahu, former defense minister Yoav Gallant, and several Hamas officials, alleging war crimes related to the October 7, 2023, Hamas attack and Israel’s justified military response in Gaza. Israeli officials have rightly rejected the warrants, calling the ICC a biased political body that targets Israel while ignoring the atrocities of terrorist groups.
