Summary

Former President Donald Trump announced plans to ask the Supreme Court to revisit its June 30 decision that affirmed automatic citizenship for children born in the United States, while also pursuing a separate petition related to the E. Jean Carroll case.

Former President Donald Trump said on Wednesday he will request that the Supreme Court rehear the case in which it upheld birthright citizenship under the Fourteenth Amendment. The Court’s June 30 ruling rejected Trump’s executive order, signed on Jan. 20, 2025, which would have denied citizenship documents to children of parents who entered the United States illegally or were undocumented.

Legal scholars note that the Court rarely agrees to rehear argued cases, with the last reversal of such a decision occurring in 1956.

"American citizenship is not for sale," Trump said, adding that he would ask for an immediate rehearing.

Trump also filed a petition asking the Court to reconsider its June 29 denial to hear his appeal of a New York jury verdict that found him civilly liable for sexual abuse and defamation of writer E. Jean Carroll. A Manhattan district judge ordered that $5 million deposited by Trump, plus interest, be paid to Carroll despite the pending petition.
