Conversely, OpenAI's legal team argued that Musk lacks a legal basis for his control claims and accused him of seeking dominance over AI development. Attorney Sarah Eddy contended, "Mr. Musk is the one whose testimony is contradicted by every other witness and by all the documents." She added that by 2017, all associated with OpenAI, including Musk, recognized the need for more funding than a nonprofit model could provide. Eddy also highlighted that Musk desired control over OpenAI's development of artificial general intelligence (AGI), stating, "Mr. Musk wanted to turn OpenAI into a for-profit company that he could control."

The trial has attracted public attention, with protesters outside the courthouse criticizing both parties as billionaires prioritizing profit over societal well-being. Signs read, "Stop replacing healthcare workers with chatboxes!" and "No future for workers in Musk-Altman fascist world." Activist Saru Jayaraman remarked, "The thing is, we're all losing, that's the main point. Who's really winning? The two of them."

The jury's decision will address whether Musk's lawsuit was timely and if OpenAI breached its founding agreement. The outcome could have significant implications for OpenAI's future and the broader AI industry.
