DOJ Reclassifies Certain Marijuana Products to Schedule III
The Department of Justice has reclassified FDA-approved and state-licensed medical marijuana products from Schedule I to Schedule III, facilitating research and aligning federal policy with state regulations.
The U.S. Department of Justice (DOJ) has reclassified specific marijuana products from Schedule I to Schedule III under the Controlled Substances Act. This change applies to FDA-approved marijuana products and those regulated by state medical marijuana licenses.
Acting Attorney General Todd Blanche stated that this action aims to expand access to approved therapies and support state-regulated medical marijuana programs.
The reclassification is expected to facilitate medical research by reducing regulatory barriers. However, it does not affect the status of marijuana used for recreational purposes, which remains classified as Schedule I.
In conjunction with this reclassification, the DOJ announced an expedited administrative hearing set to begin on June 29, 2026, to consider the broader rescheduling of marijuana.
This policy shift reflects ongoing efforts to align federal regulations with state laws and public opinion regarding medical marijuana use.
