Victorian Court of Appeal to Deliver Verdict on Erin Patterson Murder Conviction

Summary

Victoria's highest court will announce on Friday whether Erin Patterson's appeal against her triple-murder conviction and life sentence will be upheld, dismissed or lead to a retrial.

Victoria's Court of Appeal is set to deliver its judgment on Erin Patterson's appeal on Friday, addressing both her conviction for the murders of three relatives and the associated sentence. Patterson was sentenced last year to life imprisonment with a non-parole period of 33 years after a trial that concluded she poisoned a beef Wellington lunch, killing her estranged husband’s parents and aunt while also attempting to kill her aunt’s husband.

The court will consider two separate appeals: one concerning the conviction itself and another regarding the length of the non-parole period. Possible outcomes range from the appeal being dismissed to a retrial being ordered, or even an acquittal being entered. If the conviction is upheld, a separate sentencing decision may follow.

During the August hearing, Patterson's legal team argued that jurors staying in the same hotel as police and prosecutors during deliberations constituted a serious breach of fair trial standards. > "Allowing jurors to stay in the same hotel as police and the prosecution while they deliberated over their verdicts represented a catastrophic failure of the justice system," the lawyers said.

Patterson is not expected to attend the hearing in person. The court's decision will determine whether she remains incarcerated for the remainder of her life or faces a new trial and potential resentencing.
