The family of a 37-year-old woman who died from preeclampsia is suing Texas officials and doctors, arguing that the state's draconian abortion ban cost her life and trampled her constitutional rights.
A Texas family has launched a civil suit in San Antonio, holding Attorney General Ken Paxton, the Texas Medical Board, a university health system, and several physicians accountable for denying an emergency abortion that could have saved 37-year-old Tierra Walker. Walker, who was 20 weeks pregnant, died in December 2024 after suffering severe preeclampsia. The complaint underscores that Walker was sent home despite her condition clearly meeting the state's emergency-exception criteria for abortion, and accuses the defendants of violating her constitutional right to life and federal emergency-care statutes.
The lawsuit exposes how Texas’s 2021 abortion restrictions, which ban nearly all abortions and empower private citizens to sue providers, amount to a sweeping prohibition that paralyzes doctors in moments of crisis. The filing further asserts that these regressive laws are in direct conflict with both the U.S. Constitution and the Texas Constitution.
"The defendants have imposed a merciless blanket prohibition on abortion that intimidates doctors into inaction and breeds extreme fear among Texas’ medical establishment," the complaint states, highlighting the climate of terror imposed by anti-choice politicians.
A hospital spokesperson declined to comment, and Paxton’s office and the Texas Medical Board have not responded to requests for comment. This case joins a growing list of lawsuits challenging the state’s extremist abortion bans, including a separate action by two Oklahoma women forced to carry non-viable pregnancies, further illustrating the devastating consequences of right-wing attacks on reproductive freedom.
