Apple Watch audio features raise privacy law questions in several U.S. states

Summary

Apple's new Live Rewind and Siri Recap functions record brief audio snippets for transcription, prompting legal experts to question whether they comply with two-party consent laws.

Apple has added four audio-intelligence capabilities to its latest Watch models, including Sound Recognition, Music Recognition, Live Rewind and Siri Recap. The latter two can capture spoken words to generate transcriptions or conversation summaries, a function that may conflict with state privacy statutes that require all parties to consent to recording.

Live Rewind records up to 15 seconds of speech when the user activates the feature, while Siri Recap creates high-level summaries of recent dialogues. Apple says the audio is processed in a secure enclave on the S11 chip, isolated from the operating system, apps and even Apple itself, and is deleted immediately after use.

Legal analysts note that many states, such as California, Massachusetts, Pennsylvania and Washington, enforce two-party consent rules. Bloomberg reported that attorneys in those states are uncertain whether Apple’s safeguards are sufficient, because the technology continuously captures audio, which could be viewed as an interception under existing laws. > "The argument can be made that it’s unlawful because the device is picking up audio and interpreting it," said defense lawyer Phil Lauer.

The uncertainty stems from the fact that the recordings are never stored for later playback, yet the act of capturing and processing speech may still fall within the definition of an illegal recording. Experts suggest that any legal challenge would likely place responsibility on the Watch wearer rather than Apple, and that courts will need to address how privacy statutes apply to on-device, transient audio processing.
